Minor Model Release and Parent/Guardian Consent

1. Purpose

This form is optional. Our Terms of Service already allow SimonaitStudios ("we," "us") to use photographs from your Session in our portfolio and on our website and social media. The parent or guardian who accepts those Terms gives that permission for the minors in the party, subject to your right to opt out. This release records your choices in writing and lets you approve additional uses, such as paid advertising or the use of a child's first name. You may decline any use listed below, and declining will never affect the Session or your Deliverables. For adults, please use our Adult Model Release.

Use of names. We will not publish a minor's full name, school, home address, or other identifying details. Do you permit us to use the minor's first name only?

Not permitted. Unless you specifically agree in writing, we will not sell the minor's image to third parties as stock photography, and we will not use it to train artificial intelligence systems.

4. Terms of This Release

  1. Grant. For each use you initialed, you give SimonaitStudios a worldwide, royalty-free, non-exclusive license to use, reproduce, edit (for example, crop and color grade), and display the minor's likeness, photographs, video, and voice as part of the Photography.

  2. Authority. You confirm that you are the parent or legal guardian of each minor listed, or that you have legal authority to consent on their behalf, and that no other person's consent is required.

  3. No compensation. You are not entitled to payment or royalties for these uses.

  4. Ownership. SimonaitStudios owns the copyright in all Photography. This release does not transfer ownership to you or to the minor.

  5. Revocation. You may withdraw this consent at any time by emailing noahsimonait7@gmail.com. After receiving your notice, we will stop new uses and remove the images from our website and social media accounts within a reasonable time, normally within 14 days. We cannot recall material already printed, distributed, or published by third parties, or content already shared or reposted by others.

  6. Social platforms. Images posted on social media are also subject to the platform's terms, and the platform and other users may copy or share them. We cannot control their further use.

  7. No obligation to use. We are not required to use any image.

  8. Release of claims. To the extent permitted by law, you release SimonaitStudios from claims for invasion of privacy, right of publicity, or similar claims arising from the uses you approved. This does not release claims for any use outside this release or for negligence, gross negligence, or willful misconduct.

  9. Supervision. You remain responsible for supervising the minor(s) during the Session, including at locations with hazards such as water, heights, or traffic.

  10. Privacy. Information you provide on this form is handled under our Privacy Policy.

  11. Governing law. This release is governed by Michigan law. Disputes will be handled as described in our Terms of Service.

  12. Electronic signature. You agree that typing your name or clicking to sign electronically is the same as a handwritten signature.
